I avtalslagen (1915:218) finns reglerna f\u00f6r ett avtals ing\u00e5ende. Huvudprincipen i Sverige \u00e4r att avtal \u00e4r bindande enligt principen om <em>pacta sunt servanda<\/em>. Detta innefattar \u00e4ven muntliga avtal som anses bindande men i bevish\u00e4nseende v\u00e4ger skriftliga avtal tyngre i h\u00e4ndelse av en tvist. De flesta avtal \u00e4r s\u00e5 kallade <em>konsensualavtal<\/em>, vilket inneb\u00e4r att de \u00e4r giltiga \u00e4ven om de uppr\u00e4ttats i form av en muntlig \u00f6verenskommelse.<\/p>\n<p>P\u00e5 H I Juristbyr\u00e5 uppr\u00e4ttar vi en stor variation av avtal.
