3 MONTH EXEMPTION FROM MAINTENANCE AND HOUSING REQUIREMENTS

On June 18, 2019, the government determined that an extension of the law on temporary restrictions on the possibility of obtaining a residence permit in Sweden will enter into force on 20 July 2019.

This law differs in some ways from the previous temporary law, which we will tell you in the following.

People who applied for asylum after November 24, 2015 and have received alternative protection status now have the right to family reunification. But this presupposes that the person is deemed to have a well-founded view of obtaining a permanent residence permit. Due to the fact that the Migration Board previously only provided this right for persons who have received a refugee status declaration, a type of compensation has been introduced for a certain period.

This means that people who applied for asylum after November 24, 2015 and who have been granted a temporary residence permit and alternative protection status have the opportunity to constitute a related person in the case of family reunion without applying the maintenance and housing requirement for a 3 month period with start July 20, 2019. This means that the related person in Sweden, provided these requirements are met, do not have to fulfill the maintenance and housing requirement if the application is handed in before October 19 this year.
